The humanitarian benefit for victims of the armed conflict in Colombia during the 2017-2025 period

The periodic humanitarian benefit granted to victims of the armed conflict in Colombia constitutes a concrete expression of the principles of social justice and comprehensive reparation. This benefit fundamentally seeks to meet the victims’ basic needs by providing a minimum subsistence income that enables them to restore their human dignity and overcome the conditions of vulnerability, exclusion, and poverty arising from the conflict. This periodic benefit is not equivalent to a pension, nor is it financed with resources from the General Pension Social Security System. Its creation responds to the principles of the social rule of law enshrined in the 1991 Political Constitution and to the social circumstances that the country has experienced in recent years. The primary purpose of the humanitarian benefit is to protect the rights of victims of the armed conflict who, due to their incapacity, are unable to enter the labor market. This benefit will be examined in light of the principles of effectiveness, efficiency, and universality during the period from 2017 to 2025, through a review of the relevant legal and jurisprudential background, with the aim of proposing solutions to the obstacles that victims face in obtaining its recognition and effective payment.
